Retail Leases
A retail lease is a lease which gives the tenant control of a shop in order to run their business. The lease can be written, or partially written.
Usually a retail lease is for at least 5 years, however through a section 16 Certificate we may be able to get you a shorter retail lease as only lawyers or conveyance's can do so.
If you wish to exercise the option to renew you lease we can help you with that as long as you exercise the option between three and six months before your lease ends. Likewise if the lease has ended we can help you negotiate a new lease and new terms if needed.
If you take possession of the shop or begin to pay rent before the agreement is entered into the lease is deemed to have begun. So if you find yourself in that situation and you are being told you are not in a lease contact us for further advice.
We can help you negotiate the lease and its various terms such as demolition clauses, relocation, rent price, disruptions, repairs and damage etcetera.
If a dispute arises you may wish to resolve the dispute through informal means, or if the dispute is about bonds then you may be able to resolve it at the Retail Lease Bond Scheme. However if this does not work we can you take the matter further to mediation as well as the Administrative Decisions Tribunal.
